COMMON AGREEMENT LETTER

 

THIS AGREEMENT IS MADE AND ENTERED INTO BETWEEN ..,

...(HEREINAFTER CALLED THE FIRST PARTY ) AND

UPCOUNTRY MANPOWER AGENCY (PVT) LIMITED., NO. 11/5, SRI AMARAWANSA MAWATHA ,

DANGOLLA ROAD, KANDY, SRI LANKA ( HEREINAFTER CALLED THE SECOND PARTY )

 

TO RECRUIT MANPOWER FROM SRI LANKA, FOR EMPLOYMENT IN  .

THE FIRST PARTY  AGREES TO APPOINT THE SECOND PARTY AS EMPLOYMENT AGENT IN

 

SRI LANKA UNDER THE TERMS AND CONDITIONS IN THIS AGREEMENT.

THE SECOND PARTY AGREES TO FUNCTION AS EMPLOYMENT AGENT OF THE FIRST PARTY.

THE FIRST PARTY AUTHORIZES THE SECOND PARTY TO NEGOTIATE , FINALIZE AND SIGN ALL

 

AGREEMENTS   PERTAINING TO RECRUITMENT OF PERSONNEL ON BEHALF OF THE FIRST PARTY.

THE SECOND PARTY SHALL ARRANGE TO PROVIDE  MAN POWER  FOR EMPLOYMENT

 

 

IN ACCORDANCE WITH THE JOB ORDER AND THE AGREEMENT RECEIVED BY THEM.

THE FIRST PARTY WILL STRICTLY ABIDE BY AND ADHERE TO ALL LABOUR LAWS  AND

 

REGULATIONS  OF  SRI LANKA AND THE SECOND PARTY WILL FORMULATE AND  FORWARD 

 

ALL NECESSARY  PAPERS  APPROVED BY SRI LANKA BUREAU OF FOREIGN EMPLOYMENT IN

 

ACCORDANCE WITH THE EXISTING LABOUR LAWS AND REGULATIONS  OF  SRI LANKA.

 

THE FIRST PARTY WILL NOT HOLD  THE SECOND PARTY RESPONSIBLE  FOR PAYMENT OF ANY

 

CHARGE  ON REPATRIATION  IF THE RECRUIT HAS SUCCESSFULLY COMPLETED THE

 

 

PROBATION PERIOD .

THE  FIRST PARTY WILL PROVIDE  THE EMPLOYEE WITH FREE ACCOMMODATION AND FREE 

 

FOOD OR FOOD + ACCOMMODATION ALLOWANCES OF ...(AMOUNT),

FIRST PARTY WILL PROVIDE FREE MEDICAL FACILITIES.

 THE FIRST PARTY WILL PROVIDE AIR TICKET FROM COLOMBO / /COLOMBO

THE FIRST PARTY WILL INFORM THE SECOND PARTY OF THE OUTCOME OF THE IMPARTIAL

 

INQUIRIES  HELD ON COMPLAINTS MADE BY RECRUITS  WITHIN ONE MONTH FROM THE DATE

 

OF RECEIPT OF SUCH COMPLAINTS  .

WORKING HOURS WILL BE 08 HOURS PER DAY . OVERTIME WILL BE PAID FOR  HOURS

 

 

WORKED IN EXCESS OF THE NORMAL DUTY HOURS . ONE DAY OFF WILL BE GIVEN PER

RESPONSIBILITIES OF THE FOREIGN PRINCIPAL

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

  • THE SALARY AND OTHER ALLOWANCES SHALL BE PAID AS STATED IN THE LETTER OF DEMAND OR THE LETTER OF APPOINTMENT.

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

  • FREE MEALS OR MEAL ALLOWANCE OF .(AMOUNT), SHALL BE PROVIDED

 

 

 

 

 

 

 

 

 

 

 

 

  • FREE ACCOMMODATION OR ACCOMMODATION ALLOWANCE OF ..(AMOUNT),  SHALL BE PROVIEDED.

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

  • FREE MEDICAL FACILITIES  SHALL BE PROVIDED

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

  • ALL COMPLAINTS MADE BY THE EMPLOYEES OR  THEIR RELATIONS REGARDING  THE WORKING  CONDITIONS  SHALL BE SETTLED AS SOON AS POSSIBLE .

RESPONSIBILITIES OF THE LOCAL AGENT

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

  • THE LOCAL AGENT SHALL SELECT SUITABLE CANDIDATES ACCORDING TO THE FOREIGN PRINCIPAL'S REQUIREMENTS AND SUBMIT THE RELEVANT DOCUMENTS TO THE FOREIGN PRINCIPAL .

 

 

  • THE AGENT SHALL UNDERTAKE TO ENSURE THAT ALL CANDIDATES ARE SUITABLE FOR THE SELECTED EMPLOYMENT AND SHALL GUARANTEE   FOR A PERIOD OF 180 DAYS FROM THE DATE OF APPOINTMENT. THIS PERIOD IS CONSIDERED AS PROBATION PERIOD.  IF ANY WORKER REFUSES TO WORK OR FOUND MEDICALLY UNFIT DURING THE PROBATION PERIOD THE AGENCY IN SRI LANKA WILL REPLACE SUCH WORKER AT THE COST OF THE RECRUITMENT AGENT IN SRI LANKA.

  • THE EMPLOYEE OR EMPLOYEES SHALL BE ENTITLED TO 30 DAYS PAID LEAVE ON COMPLETION OF 12 MONTH'S PERIOD.

IN THE CASE OF DEATH

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

  • IN THE CASE OF DEATH OF THE EMPLOYEES DURING THE CONTRACT PERIOD , FOREIGN PRINCIPAL SHALL AGREE TO REPATRIATION  OF THE REMAINS OF THE DESEASED ALONG WITH THE PERSONAL  EFFECTS AND SAVINGS  AT THE EXPENSES OF THE FOREIGN PRINCIPAL

INSURANCE COVER

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

  • THE FOREIGN PRINCIPAL SHALL ENSURE THAT EMPLOYEES ARE PROVIDED WITH INSURANCE TO COVER   ACCIDENTS, ILLNESS, INJURIES OR DEATH IN ACCORDANCE WITH THE PERTINENT LAWS OF THE COUNTRIES WHERE THEY ARE EMPLOYED .
